At the July 11th work session, council gave staff direction to limit the contract awarding deadline to 60 days after bids were submitted. On October 18, the Town of Lexington began the legal process of pulling the bond that KB put in place and taking over the roads in Settlers Pointe. This is a legal process and the the timeline for completion is unknown. The flooding over the past year has provided more work than paving contractors can handle in a short manner. The town will work to get a contractor to handle the work once we legally can.

Town of Lexington Work Session Meeting Summary

Thank you to everyone that was able to make it to the meeting on July 11. We had 3 board members and at least 5 other homes represented. Those of you that tried to watch it on TV - the meeting was a Council Work Session and are not televised. The Work Sessions are only for open discussions between the Town's staff and council. The public is allowed to provide comment at the end of the Work Sessions. The only "votes" that can take place in Work Sessions are for specific items to be added to the regular Council Meeting Agenda, where they can be voted on, or to push items for later discussion.

Thank you to our Town’s staff and council for discussing the road situation at their monthly Work Session, with special thanks to Councilwoman Kathy Fields Maness and Town Administrator, Mr. Britt Poole for their input at the council work session.

Mr. Poole provided a status update on behalf of Mr Randy Edwards, the Town's Road and Transportation Director, who was out on vacation. The Town solicited bids for the work to be done (to be paid for by KB). The bids have been received and reviewed. The Town received bids from 3 contractors to do the repair work for the roads. All 3 declined to bid the other work (sidewalks, curbing, drainage, etc.) The low bidder has been determined for the roadway work but work is pendent on finding a contractor for the other work. The Town has now working with new contractors to provide bids on the non-road paving work needed to be done. They hope to have bids in by the end of the month.

Once the bidder for the non paving work is determined, the Town will submit the package to KB for all work to be done. The Town stated they would give KB 60 days to have the contracts awarded for the work to begin. It was stated that if KB takes 61 days, the Town will move to have the bond cashed. If that happens the Town stated they would pay for the work to be done and fight the potentially long and drawn out legal battle with KB to actually receive the money in the bond.

The Town said they would notify the HOA board when they send the package to KB and starting the clock. We are still looking at months for the actual work to begin, but we are one small step closer to having the work done. Allan spoke briefly at the end of the meeting and expressed concerns of this schedule slipping and possible weather issues into the fall and winter.
